SpaFoo, LLC (referred to herein as "SpaFoo", "we", "us" or "our") is committed to protecting your privacy and developing technology that gives you the most powerful and safe online experience. SpaFoo collects information about you when you use our mobile applications, website, and other online products and services (collectively, the "Services").  This Statement of Privacy applies to the Services and governs data collection and usage for any person who uses the Services to request on-demand beauty, wellness, styling and/or other spa services ("Users") and for any person who uses the Services in order to obtain leads and referrals for requests for beauty, wellness, and styling services from Users ("Providers"). By using the SpaFoo website, you consent to the data practices described in this statement.

Collection of Information

SpaFoo may collect personal information from or about you when you create a User account or a Provider account to use the Services. This information includes personally identifiable information that you provide directly to us, such as your e-mail address, name, home or work address or telephone number, profile picture, payment information, bank information, and other information that you choose to provide.

When you use the Services, we collect precise location data via the location services of your mobile device operating system, provided you have granted permission for the mobile application to access location services through the permission system used by your mobile device operating system.  We may also derive your approximate location from your IP address.

We collect ratings from both Users and Providers after each spa service.

SpaFoo also collects anonymous demographic information, which is not unique to you, such as your ZIP code, age, gender, preferences, interests and favorites.  We may reveal general statistical information about our Services, such as the number of Users and Providers and the number of type of spa services purchased, but we never reference you by name or specific address without your express permission.

Information Automatically Collected

The SpaFoo Services automatically collect information about your computer hardware and software. This information can include: your IP address, browser type, domain names, access times and referring website addresses.  We may collect information about your mobile device, including, for example, the hardware model, operating system and version, software and file names and versions, preferred language, unique device identifier, advertising identifiers, serial number, device motion information, and mobile network information.  This information is used by SpaFoo for the operation of the Services, to maintain quality of the Services, and to provide general statistics regarding use of the SpaFoo website.

The Services facilitate communications between Users and Providers. In connection with facilitating this service, we receive call data, including the date and time of the call or SMS message, the parties’ phone numbers, and the content of the SMS message.  However, SpaFoo does not read any of your private online communications.

Please keep in mind that if you directly disclose personally identifiable information or personally sensitive data through SpaFoo public message boards, this information may be collected and used by others.

Children Under 13

SpaFoo does not seek to collect and does not knowingly collect any personally identifying information from anyone under the age of 13.  Prior to sending any information over the Internet about themselves (for instance, names, email addresses, and phone numbers), children should always get permission from their parents.  We encourage all parents to take an active interest in their children’s online activities.

Use of your Personal Information

SpaFoo collects and uses your personal information to operate the Services and to deliver the services that you have requested.  For example, SpaFoo uses the information that we collect to:

  • Facilitate payments, send receipts, provide spa services that you request (and send related information), develop new features, provide customer support to Users and Providers, develop safety features, authenticate users, and send product updates and administrative messages;
  • Perform internal operations, including, for example, to prevent fraud and abuse of our Services; to troubleshoot software bugs and operational problems; to conduct data analysis, testing, and research; and to monitor and analyze usage and activity trends;
  • Send or facilitate communications (i) between a User and a Provider, such as estimated times of arrival (ETAs), or [(ii) between you and a contact of yours at your direction in connection with your use of certain features, such as referrals, invites, or split service fee requests - Alicia: will the SpaFoo app have these features?].
  • Personalize and improve the Services, including to provide or recommend features, content, social connections, referrals, and advertising.

 

SpaFoo may also use your personally identifiable information to inform you of other products or services available from SpaFoo and its affiliates. SpaFoo may also contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered.

SpaFoo does not sell, rent or lease its customer lists to third parties. SpaFoo may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. In those cases, your unique personally identifiable information (e-mail, name, address, telephone number) is not transferred to the third party. In addition, SpaFoo may share data with trusted partners to help us perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to SpaFoo, and they are required to maintain the confidentiality of your information.

SpaFoo does not use or disclose sensitive personal information, such as race, religion, or political affiliations, without your explicit consent.

SpaFoo keeps track of the websites and pages our customers visit within SpaFoo, in order to determine what SpaFoo services are the most popular. This data is used to deliver customized content and advertising within the SpaFoo platform to customers whose behavior indicates that they are interested in a particular subject area.

SpaFoo will disclose your personal information, without notice, only if:  (a) there is a complaint, dispute or conflict, relating to a User or Provider; (b) it is necessary to enforce the terms of your agreement with SpaFoo; (c) it is required, in SpaFoo's sole discretion, by applicable law, regulation, ordinance, license, or operating agreement; (d) it is necessary, in SpaFoo’s sole discretion, to protect the safety, rights, property, or security of SpaFoo, the SpaFoo Services, or any third party; or (e) it is necessary, in SpaFoo's sole discretion, to detect, prevent or otherwise address fraud, security or technical issues; and/or to prevent or stop activity which SpaFoo, in its sole discretion, considers to be, or to pose a risk of being, illegal, unethical, or legally actionable.

Third Party Website Links

At the present time, the website contains links to Facebook, Twitter, and Instagram and links to additional websites may be added in the future.  The website also directs users to a secure payment gateway provider in order to process users' credit card and electronic check payments.  Website users should consult the Facebook, Twitter, Instagram and Authorize.net privacy policies and those of any other third-party websites to which links are provided in the future to determine their respective information practices.

Use of Cookies

The SpaFoo website use "cookies" to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.

One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the web server that you have returned to a specific page. For example, if you personalize SpaFoo pages, or register with SpaFoo site or services, a cookie helps SpaFoo to recall your specific information on subsequent visits. This simplifies the process of recording your personal information, such as billing addresses, shipping addresses, and so on. When you return to the same SpaFoo website, the information you previously provided can be retrieved, so you can easily use the SpaFoo features that you customized.

You have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the SpaFoo Services.

Security of your Personal Information

SpaFoo secures your personal information from unauthorized access, use or disclosure. SpaFoo secures the personally identifiable information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure. When personal information (such as a credit card number) is transmitted to other websites, it is protected through the use of encryption, such as the Secure Socket Layer (SSL) protocol.  This prevents your information from being read during transmission over the internet.

Changes to this Statement

SpaFoo reserves the right to modify this Statement of Privacy at any time in our discretion by posting the modified policy on this website, which policy will be effective upon posting, as indicated by the "Effective Date" at the top of this page.  As we may make changes from time to time, we suggest that you frequently review the Statement of Privacy.  By using the Services after the effective date of any modification to the Statement of Privacy, you consent to the collection, use, and sharing of information as described in the modified Statement of Privacy.
